Court: “Court of Auditors not authorized to audit UTS”
WILLEMSTAD – According to the Court of Justice in the case of the government against the public company United Telecommunication Services (UTS), the Court of Auditors (ARC) is not competent to conduct an audit in the company. The judge has prohibited the ARC to continue their announced audit.
The judge indicated in his ruling that the ARC has jurisdiction to conduct audits in government entities or the government itself. UTS and its subsidiaries should not be included as a government entity. “The request by parliament to investigate the books of UTS has therefore no legal basis,” said the judge.
UTS has protested since the beginning when parliament indicated that they want the ARC to audit the company. The minority shareholder of the UTS voiced their concern about the audit and said to find it undesirable. The company is concerned that the competition will receive sensitive information when the ARC reports its findings to parliament.
