Environmental groups seize accounts oil refinery
WILLEMSTAD – Environmentalist groups SMOC and Humane Care will collect 75 million guilders from the oil refinery Isla and the Build Own and Operate (BOO) plant. Through a so-called garnishment.
The judge imposed a fine on appeal in 2010. To be paid for each year that there are more sulfur dioxide emissions than permitted.
The judge then also determined how it should be measured. From those measurements it shows that in 2013 in both the best scenario and the worst case scenario, the refinery went way over the standards.
Through the maze of Isla-corporate vehicles it will take some time to find the correct account of Isla and BOO, where the money is.
Isla has filed a lawsuit against the environmental groups and residents. According to the Isla they used a miscalculation, which is contrary to what the judge indicated in 2010. The seizure was therefore unlawful.
Isla denies to have exceeded the norm and holds SMOC and Humane Care and the 25 residents severally liable for the damage caused by the seizure.
The lawsuit is on Tuesday, October 27th at 14.15.
