The Public Prosecution and politically motivated complaints

WILLEMSTAD - The public prosecutor has been confronted, in recent months,with many politically motivated complaints, made by concerned citizens, politicians and interest groups.

The Public Prosecutor, in principle, exercises utmost restraint in prosecuting politically motivated complaints. This concerns in particular complaints of defamation, slander and libel from the political arena. The Prosecution assumes that, in principle, what in the political arena is brought forward, must be resolved in the same political arena.

If the public prosecutor takes role of arbiter in the political jousting, then there is a danger that the impartiality of the Public Prosecutor in our society can be questioned. The complaints that are filed to the public prosecutor are, without exception, reviewed by a prosecutor. This has in some cases led to a police investigation or an investigation by the special police investigators. The latter may be the case if there is a complaint of bribery in a political setting, threat and sedition.

The Prosecution, in its assessment, also take into account the danger of influence in the political arena that investigation and prosecution actions can bring about, especially in the run-up to the elections. This may cause certain operations to be delayed.

The Prosecution finally stressed that it is a public body, responsible for combating crime by making detection and prosecution of offenders. It strives to make Curacao safer for all its citizens, regardless of political affiliation or belief.
