Venezuelan refugee officer may not be deported for the time being

This has been determined by the judge in a provisional measure.

Lino Zavala invokes Article 3 of the European Convention for the Protection of Human Rights (ECHR). It provides that no person may be returned who, on return, is at risk of inhuman treatment or punishment by the authorities. Zavala cannot be expelled in any case for as long as the procedure is in the process, until 14 days after that.

Zavala says he has witnessed election fraud in Venezuela during the April election and therefore feared for his life. Together with Venezuelan sergeant Mauricio Loaiza Ordoñez he arrived in Curaçao with a boat without identity papers. He has also applied for political asylum and is still behind bars in the SDKK prison.

Lino Zavala's request to be allowed to wait for the procedure in freedom has not been granted by the court. The court finds that the minister has sufficient reasons for this because Zavala illegally entered Curaçao and therefore wanted to withdraw from the supervision of the authorities from the very beginning.
