Judge in Babel case disqualified by defense lawyer
WILLEMSTAD - Judge Irma Lips, charged with the substantive proceedings against the suspects in the Babel case, Gerrit Schotte and Cicely van der Dijs was disqualified by attorney Eldon ‘Peppie’ Sulvaran.
The defense of the couple thinks that Lips is biased and mentioned the rejection of several requests to hear witnesses during the pre-trial last June.
Sulvaran requested the hearing of over 40 witnesses in the case and most of them were rejected by Judge Lips. Among those witnesses were former Governor of Curaçao, Frits Goedgedrag and Attorney General, Anton van der Schans.
The Public Prosecutor opposed the disqualification of the judge.
“The disqualification request was made too late, on August 14, while the pre-trial took place in June. Why wait until now to challenge the judge?”
The prosecution also stressed that the defense is abusing the challenge right, as this is a means to enable an "internal appeal" against unwelcome decisions.
Furthermore the prosecution considers the action of the defense a smokescreen to make a political trial of the Babel case. In this connection, the prosecution asked the court to declare inadmissible or reject the disqualification request.
