Konket: “Minister Balborda is violating his oath”
WILLEMSTAD – The opposition party PAR, through Armin Konket MP, has noted that the Member of Parliament for the coalition party PNP, Humphrey Davelaar gave Minister Earl Balborda till Wednesday, March 4, 12:30 pm to resign as Minister of Traffic, Transportation and Urban Planning. This entails that Balborda, at exactly 12:30, does not enjoy the support or trust of the Member of Parliament Humphrey Davelaar. This means that the 11 MPs, a small majority, who were supporting Balborda, has been reduced to 10, which is not a majority anymore.
Nevertheless, Balborda did not resign. He decided to submit his position to the judgment of the party. The fact that Balborda says that he will leave the decision to a general meeting of PNP entails that Balborda is violating his oath as minister. Balborda, conform article 36 of the Statute, has sworn to be loyal to the King and the Constitution. Article 29 subsection 2 of the Constitution stipulates that “If a Minister does not have the support of Parliament, he should resign.”
The fact that Davelaar has openly and publicly withdraw his support from Balborda has caused that there is no one in Curaçao that doesn’t know that there is a break between the two. The position taken by the general meeting of the PNP is not relevant. This organ of the party does not have any power in the Constitution. However, Balborda, with his actions, has shown that he gives more relevance to his party than to the Constitution, which obviously is not right.
