Court cases in Curaçao are different compared to United States

judge-hammer1-courtWILLEMSTAD – In the United States of America you expect in a court case to hear testimonies and opinions of various experts on the topic being discussed, such as experts in ballistics, technical investigation, etc. You can expect images, videos, clothing, weapons, even a mannequin, which is used to show how the victim fell on the floor and where the bullets entered the body. The U.S. court system can be quite interesting. The decision if the defendant is guilty or not is usually made by a jury.

Here in Curaçao it’s quite the contrary. The Public Prosecution (OM) will prepare a document of 1000+ pages which includes all pictures and detailed description of their investigation. The OM is obligated to share this document with the lawyers, judge and the Attorney General. All they do is talk in court and give the defendants the opportunity to speak on his own behalf. The court can be used if a lawyer wants to physically see an evidence, which was not clearly shown in the documentation. Sentencing is done by the judge.
