Court: “Government has to prove what it is doing against air pollution

WILLEMSTAD - The government of Curaçao must safeguard the health of residents under that live in the vicinity of the refinery, especially the areas that are under the smoke. This is what the Clean Air Everywhere foundation together with 29 residents is demanding in a new trial that was filed to the Court of First Instance on January 14. The foundation and the residents do not conduct proceedings against the polluters themselves, but against the government. It is liable according to the foundation and the residents for the air quality in Curaçao.

 

In the assessment, the Court of First Instance reiterates that this new case is not against the Isla refinery or the Aqualectra / CRU utility producer that pollutes the air. It is the responsibility of the Curaçao government to guarantee clean air to its residents. To be able to determine this, there will be a special court session where further explanation can be given about the issues.
