WILLEMSTAD - The Public Prosecutor’s Office (OM) has demanded a 12-month prison sentence, three of which suspended, against 72-year-old driver S.L. for his role in the fatal accident that claimed the life of 15-year-old cyclist Giomar “Gio” Hellemun on July 4, 2023, along Kaya Jose Papa Liberia.
According to the prosecution, the man was driving his Hyundai I-10 in a reckless manner and under the influence of alcohol. A breathalyzer test failed due to a technical defect, but a subsequent blood test revealed an alcohol level of 0.79 promille. S.L. admitted in court that he had consumed three glasses of whisky that evening.
The defendant told the judge that he had suddenly taken a turn, felt an impact, and then stopped. Only afterwards did he realize he had struck a bicycle and saw the lifeless body of the teenager. Investigators later determined that his speed was 71.5 kilometers per hour at the time of the collision.
Mother’s emotional testimony
The victim’s mother was present in the courtroom and shared that she continues to need psychological help following the loss of her son. She described the profound and lasting pain the tragedy has caused her family.
Prosecutors emphasized that the suspect had shown no remorse and acted irresponsibly. “Had he not been drinking, he might have seen the boy and avoided the accident,” the prosecutor argued, adding that while no one sets out to kill someone when they get behind the wheel, that is no excuse for reckless behavior.
Defense pleads for acquittal
The defense countered that the incident did not constitute manslaughter, pointing out that the teenager was cycling in the dark, dressed in black clothing, and without lights on his bike. The lawyer argued that his client could not have seen the boy after taking the corner and therefore should be acquitted.
The court is scheduled to deliver its verdict on October 24.
